The Basic Internet Dial Up Service Package and the ISDN Internet Connection Packages all include the following:

This agreement is made between CROS.NET, Inc., 125B Maple St., Port Clinton, OH 43452 Phone 800-541-7779 and the customer (listed below).

Network Use Policies: Misuse
Customer agrees to adhere to the network access policies and procedures of CROS.NET and not to use its network for any illegal purpose, and not to place or cause to be placed on CROS.NET’s network any material which violates the copyright, trade secrets or other proprietary rights of third parties, or which is threatening or which otherwise violates any federal, state or local laws. Customer agrees to indemnify, defend, and hold CROS.NET harmless from any claims resulting from any such misuse or any use that violates CROS.NET’s network access policies.

Payment
CROS.NET will bill monthly accounts in advance by E-mail on or before the customer’s original start date. Other plans will follow by postal mail. Customer agrees to pay CROS.NET within 10 days of the bill date. All accounts over 30 days past due will be disconnected as of the end of the current period and a $2.00 late fee will be applied. Delinquent customers turned over to collections will be liable for any fees that may occur. There is a $5.00 reconnection fee to reactivate services for a delinquent customer. Limited accounts will be charged $1 per hour for each hour over their account limit per month. All credit card numbers will be kept on file. We are required by law to charge Ohio sales tax on all Company Internet Accounts, unless there is proof of tax exemption.
Cancellation
Customer must notify CROS.NET in writing in order to cancel their account. Credits due to users with prepaid accounts will be calculated using the monthly rate. The first month of service is not refundable.

Warranties
CROS.NET warrants that it will provide the services specified above in a professional manner and in accordance with the standards prevailing in the industry; and in accordance with all applicable laws, ordinances, rules and regulations, now or hereafter in effect in the United States. CROS.NET will, at all times, monitor its network and its interconnections to other networks and use reasonable efforts to maintain its data network, including interconnections, in an operational state at all times. CROS.NET has the right to change the terms of this agreement at any time. In that event, an update will be posted on our home page.
